THE MUMS OF THE HILLS INC
R.U.T.H. RUN 2024
Definitions
The meanings of the terms used in these Terms and Conditions are set out below:
Event means the fun run/walk and other activities to be held on 22 September 2024known as the R.U.T.H Run 2024, organised by Mums of the Hills Inc.
Event Officials means officials authorised by Mums of the Hills Inc to officiate at the Event and/or to assist in its planning, preparation, management or clean up.
Event Staff means staff employed or contracted by Mums of the Hills Inc (whether as employees or independent contractors) to work at the Event and/ or for its preparation or clean up.
Event Registration Fee means the registration fee payable by an Entrant to participate in the Event.
Event Terms means these Terms and Conditions.
Event Volunteers means volunteers providing services to Run2Cure / Mums of the Hills Inc for the purpose of assisting the conduct and running of the Event and/or its preparation or clean up.
On-line Registration Platform means a digital technology solution that allows Entrants to register for the Event, create a fundraising page, join or create a team, acquire merchandise and/or donate monies to Mums of the Hills Inc.
Minor means a person aged 18 or below
Entrant means a person registered to participate in the Event, and includes a person who registers for and on behalf of another Entrant (whether or not that other Entrant is a minor).
Mums of the Hills Inc refers to registered charity Mums of the Hills Inc (ABN 13 459 400 521)
Entry to Event:
By registering for the Mums of the Hills Inc fun run and walk (the Event), I agree to the following terms and conditions for and in respect of myself and each other person that I enter into the Event by buying him or her a ticket to enter into the Event, including any minors (Entrants):
Registration
I warrant in respect of each minor under 18 years that I register in an Event that I am over 18 years of age and I am the minor’s parent or legal guardian and that I will be totally responsible for his or her welfare, safety and well-being throughout the Event and agree that they will not be left unattended at any time during the Event. If I do not attend the Event I will arrange for the minors that I have registered to be accompanied by an adult who I acknowledge and agree will be totally responsible for their welfare, safety and well-being throughout the Event and agree that they will not be left unattended at any time during the Event. I acknowledge that the organisers of the Event disclaim all responsibility for the welfare, safety and well-being of minors I have registered and are not under their care at any time. I agree that if I have registered a minor under the age of 12 to participate in the fun run/walk that I will (or will arrange another adult to)
1.1 accompany each minor which I have registered at all times during the participation in the fun ran/walk and during the Event.
1.2. If I am registering any other person in the Event (whether a minor or adult) I certify that I am the duly authorised agent/attorney for that Entrant. I certify that I have read this document and fully understand the terms and conditions contained herein and as agent/attorney I am authorised to and do hereby agree to these terms and conditions for and on behalf of all persons registered as Entrants.
1.3. Mums of the Hills Inc has the right to exclude an Entrant from participating, or continuing to participate in the Event if it is in the opinion of Mums of the Hills Inc that the Entrant is not complying with any of the Event Terms.
Registration Fees
2. No registration is accepted or is complete until the Event Registration Fee is paid in full
3. All entries are non-transferable and non-refundable unless a request for a refund is made prior to 18th September 2024 for a medical reason supported by a medical certificate. To make a request please notify Mums of the Hills Inc via email to contact@mumsofthehills.com.au.
4. All registration fees and donations will be processed by Mums of the Hills Inc through its Stripe account. Donations and funds raised will go to the registered charity Black Dog Institute (ABN 12 115 954 197) and help support research into mental health. Donations are non-refundable.
Fundraising
5. I understand fundraising for Mums of the Hills Inc is an optional extra at the Event but an objective of the Event. Donations can be made online via the Mums of the Hills Inc website and will be processed through the group’s Stripe account. Mums of the Hills Inc does not have deductible gift recipient (DGR) status so donations can not be claimed for tax. I acknowledge these donations are non-refundable.
Competing in the Event
6. I acknowledge and agree as follows:
(a) Entrants participate in the Event entirely at his or her own risk.
(b) Entrants will take all reasonable measures to protect him or herself from the risks of participation.
(c) Entrants accept all responsibility for travel and medical insurance and for payment and/or reimbursement of medical/surgical expenses incurred on their, his or her behalf.
(d) Entrants acknowledge that the Event involves the real risk of serious injury or risk of death, from various causes including but not limited to over-exertion, dehydration, accidents with other competitors, spectators and road users, animals and weather conditions. Each Entrant (or his or her parent or legal guardian) has voluntarily read and understood this warning and accept the inherent risks of the Event.
(e) To the best of each Entrant’s knowledge, he or she is not suffering from a condition, which would prevent and/or render them unfit to participate in the Event. Each Entrant recognises the difficulties of participating in the Event and attests that they, he or she is physically fit to compete safely, have trained sufficiently and have not been advised by a qualified medical practitioner not to compete in the Event. Each Entrant agrees that they, he or she enters into the Event at their, his or her own sole risk.
(f) Entrants are responsible for all property brought to the Event sites. Entrants acknowledge that Mums of the Hills Inc accept no responsibility for any loss or damage to this property. Entrants consent to the conduct of identity verification checks, security checks (which may include inspecting my personal property) prior to entry to and departure from the Event sites.
(g) Entrants undertake to comply with all applicable regulations, by laws and rules of the Australian Sports Anti Doping Agency (ASADA) in relation to the Event. Entrants will walk and/or run with care and take all reasonable measures to protect themselves from the risks of participation. Entrants agree to abide by the directions and decisions of the officials, and other representatives of Mums of the Hills Inc.
(h) Entrants, in participating in the Event, must abide by all instructions given to them by Event Officials, Event Staff and Event Volunteers.
Disclaimer and Liability
7. In consideration of Mums of the Hills Inc accepting the application to enter the Event, I agree that :
a) Each Entrant hereby releases, discharges and forever holds harmless the organisers of the Event including without limitation Mums of the Hills Inc (and their committee members, volunteers, contractors, sponsors and / or agents) from any action, suit, proceeding, claim, demand, damage, penalty, cost or expense and from any liability (to the extent permitted by law) for or as a result of any loss, injury, death or damage suffered by an Entrant in relation to his or her attendance and participation at the Event, how so ever caused, including any claim or liability which arises due to any negligence of Mums of the Hills Inc, (and / or their committee members, volunteers, contractors, sponsors and / or agents); and
b) Each Entrant indemnifies and will keep indemnified Mums of the Hills Inc, (and/or its directors, officers, employees, volunteers, contractors, sponsors and/or agents) in respect of any action, suit, proceeding, claim, demand, damage, penalty, cost or expense by any person and from any liability arising as a result of or in connection with his or her participation at the Event and/or a breach of these terms and conditions.
Media
8. I consent to the publication and/or use in any form of media whatsoever of each Entrant’s name, race result, image, voice, statement or otherwise, including the publication of Entrant’s names and/or event results and applicable age brackets in /or marketing materials/website without payment or compensation. On behalf of any minor I enter into the Event, I consent to the use of their first name only, race results, image, voice, statement or otherwise and applicable age bracket being used to promote the Event in any form of the media without payment or compensation.
Postponement or Cancellation of Event
9. If the Event is postponed for safety concerns or otherwise as a result of something beyond the reasonable control of Mums of the Hills Inc, including without limitation strong winds, heavy rain, lightning and accidents, I accept that all Entrant’s will be notified of the rearranged date. Mums of the hills Inc will continue to reschedule the event until safety concerns are low.
Consent to Receive Communications
10. I consent to the personal information of each Entrant being provided to Mums of the Hills Inc.
11. I consent to each Entrant receiving regular emails, newsletters or SMS updates from the Event organisers/sponsors/partners to keep them informed about the Event.
12. If you wish to opt-out of receiving communications from Mums of the Hills Inc and organisers/sponsors/partners of the Event please email contact@mumsofthehills.com.au
Terms and Conditions of Site Use
These Terms and Conditions of the use of this digital platform (Site) govern your use of this Site. If you are using this Site to register for The R.U.T.H Run 2024, these Terms and Conditions of Use of Site (Site Terms) must be read together with the Terms and Conditions of the Mums of the Hills Inc The R.U.T.H Run 2024 (Event Terms), which can be viewed above.
Credit Card Payments
13. Any payment for registration fees, donations, purchases or other transactions made through the Platform by a User inserting the User’s credit card details is final and not disputable. Where there has been an unauthorised use of a User’s credit card, and the unauthorised nature of that use is proved, then the payment will be refunded unless it has already been credited to the relevant Beneficiary.
14. In the event of unauthorised use of Your credit card, You must notify your card provider in accordance with its reporting rules and procedures.
15. All transactions are in Australian Dollars. Transactions will appear on your credit card statement as Mums of the Hills Inc.
Online Donations and Receipts
16. The net proceeds of all monies donated to Mums of the Hills Inc are used charitably at the discretion of Mums of the Hills Inc’s committee, to support its operations, events and research projects. The various research projects supported by Mums of the Hills Inc are listed on Mums of the Hills Inc’s website (www.mumsofthehills.com.au)
Governing Law
17. The laws of Victoria and the Commonwealth of Australia (as applicable) govern these Terms and Conditions.
18. Clauses 23, 28, 31, 32, 33, 34, 35, 36, 42 and 44 survive termination or expiry of these Site Terms as between Mums of the Hills Inc and the User.
Privacy Policy for Mums of the Hills Inc
Mums of the Hills Inc cares about protecting your privacy and handling your personal and sensitive information with care. We ensure that our conduct complies with the Australian Privacy Principles contained in the Privacy Act 1988 (Cth) (‘Privacy Act’).
The purpose of this privacy policy is to inform you about the range of circumstances in which we collect personal information. It also explains how we will use or disclose that information.
What Personal Information does Mums of the Hills Inc collect and why?
Personal Information is information about an identified individual, or an individual who is reasonably identifiable. The Personal Information we collect about you will depend on the way in which you interact with Mums of the Hills Inc.
Donors, event participants and purchasers of products:
When you make a donation to Mums of the Hills Inc, participate in an event or purchase a product from our online store, we ask you to provide your name, contact information (address, phone number & email address), credit/debit card information, and interest in receiving newsletters and other similar communications. If you attend / participate in a Mums of the Hills Inc event, we may also ask you how you heard about the event and also record the number of times you have participated in the event and your reason for signing up.
We will collect this information so that we can process your donations and/or merchandise purchases, provide you with receipts for donations and/or purchases, confirm your identity, respond to your queries or complaints, assist us with our internal reporting, and communicate with you regarding news, events, fundraising, campaigns, products and services.
How do we collect your Personal Information?
Wherever possible we will only collect your personal information directly from you.
This may be in person (for example at a fundraising event); on the telephone (for example if you phone us for information or advice); online (for example if you purchase tickets for events, products from our store, sign up to a newsletter, make a donation online or sign up to an event); or by email (for example if you contact us with a question or query).
How to access and/or make corrections to your personal information
You have the right to request access to, or seek correction of, your personal information held by us at any time. In order to comply with the Privacy Act we will require you to answer security questions prior to the release of any information so that we may ascertain your identity. If you wish to access or correct your personal information please contact contact@mumsofthehills.com.au . We will deal with all requests as soon as possible but no longer than 30 days.
If you have any queries or complaints relating to Mums of the Hills Inc’s Privacy Policy or the manner in which we handle your personal information please contact our Privacy Officer. We will respond to your complaint in writing as soon as possible but no longer than 30 days. If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner.
Opting out of direct marketing communications
Where we use your personal information to send you marketing and event information by post, email or telephone, we will provide you with an opportunity to opt out of receiving such information. By electing not to opt-out, we will assume we have your implied consent to receive similar information and communications in the future.

Competitors under the age of 18 years
I, ………………………………………………………………………………………………, being the parent or guardian of the person named in the indemnity above Acknowledgement, Release and Indemnity (“the Indemnity”) hereby acknowledge and agree that:
I have read the whole of this document and understand it and have explained it to the person named in the Indemnity;
I consent to the person named in the Indemnity participating in the Event; and
I am aware of the risk, dangers and obligation set out above in the Indemnity.
In consideration of the person named in the Indemnity being accepted to participate in the Event, I agree to release and indemnify the Event organisers, its officers, employees, agents, volunteers, contractors, public bodies, landholders and sponsors, in the same manner and to the same effect and extent as if I were the person named in the Indemnity and the person participating in the Event.
